Tuesday, April 27, 2010 at 10:19PM A political sketch group called The Full Ginsberg got a digital half-nelson from a rapid assault pack of Tea Party people. Earlier this week, The Full Ginsberg posted to YouTube a video in which one of them pretends to be the CEO of Crayola, who's extremely pleased with the recent surge in marker sales. The shitty protest signs the teabaggers are making are helping Crayola's bottom line and 1st quarter profits are soaring or whatever.

The vid was picking up a couple thousand eyeballs and then ZOINK--YouTube turned off the utilities:

> "This video is no longer available due to a copyright claim by Hallmark Cards, Incorporated."

The Apiary asked Eric Cunningham, a spokesperson for TFG for the story and he tells us, "Some tea partiers raised a stink and pretended to not get that it was a parody and asked Crayola to remove the video." With wistfulness and resolve, he then added, "Here's the Funny or Die version."

Man, that was vicious of the tea partiers! How could anyone even remotely think that it was real and not a parody? Impressive that the video took off and got so many hits so quickly.. clearly a hot-button issue.

Dear Crayola,

I was raised using your products and have purchased countless crayons and markers from your company for my own child. I have always applauded your company being on the front lines when it comes to green issues. Moreover, as a company that produces writing implements, I would expect Crayola to stand for free expression.

Given this, I am very concerned that Crayola would allow itself to be bullied by tea party radicals who took offense to an obvious parody video put out by The Full Ginsburg ("TFG"). There is no way that anyone would think that TFG's video was actually from Crayola or Hallmark. Crayola has allowed itself to be used as a tool against freedom of speech. I urge you to be mindful of the fact that there is much greater potential fall out against Crayola's corporate image from blocking the parody with a take down notice, not to mention liability for preventing fair use under copyright law, than the supposed danger in causing offense to individuals who claim to support freedom while gagging free expression. Thank you for reconsidering your position in this matter.

April 28, 2010 | Bob Now the LEFT is going to boycott Crayola for asking TFG to take down a video they created using Crayola's trademark to make a political statement that Crayola might not find advantageous in the free market? Is the left for real? You're entitled to your free speech. You're not entitled to make a political rant and claim somebody else said it. That's not free speech, that's called libel.

This is not a case of FAIR USE. I can't represent myself as someone I am not (using their trademark) and make libelous statements against a 3rd party and claim that it's fair use.

Learn the law before you start boycotting Crayola for exercising the right to protect their trademark.

TFG can be sued if Crayola decides to. They have a solid case. TFG has potentially caused restraint of trade by assigning their political views onto Crayola and taking sides in a extremely volatile and polarized political climate. This could effect their bottom line.

April 29, 2010 | Hilarious Hilarious, you are obviously not a lawyer. TFG's video is not liable and it's not trademark infringement. Crayola's lawyers will reach the same conclusion and will be wise enough to not waste their money suing over it.

The video is parody, protected by the 1st Amendment. The fact that Tea Baggers aren't capable of seeing the obvious satire in this video should be all the proof anyone needs to know that their so-called movement to perpetuate an "extremely volatile and polarized political climate", is doomed.

Meanwhile, many thanks to "iowntheworld.com" and others for giving this video so much additional publicity.

April 29, 2010 | Freedom of Speech You're not getting it, are you.

It's fair use to make a video parodying a corporation.

TFG did not do that.

They made a video which pretended to be a corporation as they libeled a third party, attributing the libel to a company's trademark.

That company has the right to protect their trademark.

What if I made a video that was going to denounce Muslims and the Koran, but in producing that video I attribute everything I am saying to some other company. That isn't fair use, pal.

I weep for this country. it's filled with idiots that cannot grasp the simplest of concepts.
